A federal high court sitting in Abuja has denied the request of Mohammed Tukur Mamu seeking to transfer from the custody of the department of the state service (DSS) to the Kuje correctional centre. The presiding judge, Justice Inyang Ekwo, in his ruling, cited the increased cases of jail breaks across the country as reason for his opposition to the request and therefore ordered Mamu to remain in the custody of the DSS till the determination of his suit.
Mamu was arrested on September 6th, 2022 at the Aminu Kano international airport upon his arrival from Egypt and has since been on trial over his alleged ties with with the terrorists who attacked the Abuja-Kaduna train on March 28, 2022.
Justice Ekwo, however, affirmed his earlier order that the defendant be allowed access to his physicians for purpose of medical treatment with the supervision of the DSS.
Mamu, through his lawyer, had on April 29, alleged that the order of the court made on December 19, 2023, that he be allowed access to his physician for medical treatment was not complied with by the DSS.
Mamu committed to regular court appearances but noted the importance of seeing his doctors, as, according to him, only those alive can show up to court.
The DSS, on March 21, 2023, arraigned him on 10 counts of terrorism financing, among others but he pleaded not guilty to the charges.
